Breaking News: Reiser Will Testify
Today’s session was otherwise unremarkable.
The jury was sent home early in order for the defense to argue a mistrial motion growing out of a contretemps that occurred earlier when Bill DuBois was chastised in front of the jury - improperly chastised the defense argues – over a dispute about exactly what young R. (Hans’ son), had said on the crucial matter of Nina’s departure from the Exeter house on 9-3-06.
As I indicated at the time, we can expect the court to address the problem in the instruction to the jury; a mistrial will not be granted, in my opinion.
But we were treated to a window into the inner working of defense planning when the judge revealed the forthcoming schedule.
Tomorrow: A Reiser family law juvenile court attorney continues with testimony. (See my summary below). Then, as time allows we are to expect the following:
A defense DNA expert
A defense shrink

Chirstopher's second comment exposes the hidden tragedy in this case. If you falsely claim that a killing didn't happen or that you didn't do it, then - in the real world - you can't expect any measure of mitigation due to "provocation" and so on. Defendants can't have to both ways.
As to the first point, about all those unanswered questions: Again, in the real world, all questions are never answered. C asks:
"In the absence of satisfactory answers to these questions I wonder if you would be so kind as to explain why I should not think that Justice as dispensed in California is nothing but a charade, or a rather poor parody of the real thing?"
We have, and always have had, reasonably good justice, based on reasonably good investigations, most of the time. The "CSI" effect has raised expectations far beyond the attainable in the real world.

Good God Almighty!! It looks suspiciously like the officers of the Court monitor Slashdot.org! I can't help but wonder if they read this huge thread and in particular my posting and the replies to it. Looks horribly like it to me. The mind boggles at the possibility that postings to the News for Nerds blog from an alien and some 755 other people can actually influence the course of Justice in the US!Let's assume for a moment that the mind does indeed boggle, because the court and its officers actually read these 'blogs. So let's suggest that they ask these as yet unasked questions:-
- Exactly how did Hans' blood get on the door post at the reported 3 foot 6 inch level? It seems to be at the wrong height for something recent. Was it in fact caused by a superficial wound Hans suffered during childhood or adolescence?
- It's reported that this stain was a mixture of blood from both Hans and Nina. Can we be certain that this mixture is composed of full blood components from both of them? As opposed to blood from Hans combined with contaminating cells from Nina containing her DNA.
- What efforts have been made to find Nina either dead of alive? Have the nearby lakes been dragged with a line or scanned with a sonar set for a body either in a cement sarcophagus or floating freely in the water? If not why not? It's a normal first procedure in most jurisdictions when somebody disappears under suspicious circumstances.
- What was the white powder found in the hall-way of the house?
Was it something innocent like castor-sugar, baking-powder, or flour, or was it something more sinister? Something like cement, quick-lime or plaster? If so what was the activity which caused it to be there?
- It's been reported that a pristine brand-new pick-axe and two shovels or spades were found in the under-house of the Exeter Road property. When were they purchased and for what purpose? Was any DNA or finger-prints found on them. If so, to whom do they belong? Why one pick-axe, yet two spades? Does that suggest an accomplice might have been involved? If so, who is {s}he? Could {s}he be turned to provide evidence for the People?
In the absence of satisfactory answers to these questions I wonder if you would be so kind as to explain why I should not think that Justice as dispensed in California is nothing but a charade, or a rather poor parody of the real thing?Please be aware that I'll be asking questions about 'sanity', 'provocation', 'diminished-responsibility', 'compassion', and 'mercy' later on.
